1. The Defendant shall pay to the Plaintiff KRW 1,401,950,721 as well as 20% per annum from December 27, 2013 to the date of full payment.
Reasons
1. Basic facts
A. 1) The Plaintiff is the party’s position 1) among the “Construction Works for 1 Section 1 Section and 2-2 Section 2 Section 1 Section 2” in the “Construction Works for 4 Section 1 Section 4 Section 4 Section 4 Section 4” from the Daegu Southern Metropolitan Circulation Road Co., Ltd., the Plaintiff is the party’s “Construction Works for 1 Section 1” and the “2-2 Section 2”, and each of the above Construction Works is the “each of the instant Construction Works.”
(2) The Defendant is a company that received a subcontract for each of the instant construction works solely or jointly from the Plaintiff.
B. 1) The Defendant, along with the Youngjin Construction Co., Ltd., was awarded a subcontract for the instant Section 1 from the Plaintiff during the construction period from January 2, 2009 to October 31, 2012, setting the construction cost of the instant Section 1 from the Plaintiff around 30,250,00,000, and the construction period from January 2, 2009 to October 31, 2012.
2) On September 7, 2009, the Defendant was awarded a subcontract for the instant 2-2 construction works from the Plaintiff for the period from September 7, 2009 to September 30, 2012 by setting the construction cost of 23,786,793,800 won, and the construction period of 2-2 construction works from September 7, 2009 to September 30, 2012.
3. Each of the above construction contracts was modified after two or three times as follows, and the content of each of the construction contracts was modified on December 21, 2012, and finally, on December 21, 2012, the instant construction contract was amended by 44,97,900,000 won in the construction cost, and the instant 2-2 construction project was amended by 28,710,647,90 won in the construction cost, and the expiration date of the construction period of each of the above construction works until February 15, 2013.
Until December 23, 2012, 201, December 21, 2012, 2012, the changed construction period of one Section for the changed construction period of the changed construction date, as of January 19, 2012, shall be 25,879,907,900 won until February 15, 2013, no later than December 23, 2012, from construction works of 2-2 Section for the changed construction period of two sections until February 15, 2013.
C. One of the Defendant, including disputes over the construction cost and arbitration ruling, demanded the Plaintiff to increase the construction cost in addition to the construction cost under the modified contract. However, the Plaintiff refused this and the Defendant.
