Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for eight months, respectively.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 9, 2017, the Defendants were sentenced to a suspended sentence of two years for a year due to the establishment of gambling space in the Seo-gu District Court’s branch, and operated the private futures trading site in the name of “E”, “F”, and “G” along with D (Seoul District Court’s recent appellate trial).
1. Violation of the Financial Investment Services and Capital Markets Act and the Defendants establishing gambling spaces are gathered with D, and D establish an office and bring about division of profits after dancing the funds required therefor. The Defendants decided to operate a private futures trading site in a manner that takes full charge of the affairs such as membership recruitment and management, site management, fund management and settlement, etc. of the above site, and to establish gambling spaces.
The Defendants and D, in accordance with the foregoing mothers, opened a private futures trading site in the name of Daegu Suwon-gu H and China depth (hereinafter “E,” “F,” and “G” in the name of “HTS (HTS) at the early January 2017, from February 2016 when members subscribed to and connected with a computer and thereafter deposited cash in the account designated by the Defendants for the said futures trading, and recruited members to use the HTS implementation file by e-mail. When members subscribed to and connected with the said company’s computer, they accumulated cyber money into the said HTS at the rate of 1:1; and when members request the members to enter the company’s office in cash in connection with a member’s futures trading loss; and when the members request the members to withdraw the remaining amount of money from the account under a certain rate of futures trading in connection with the members’ futures trading, they completed the pertinent futures trading contract’s profits.
