Facts of recognition
The plaintiff is a company engaged in manufacturing and wholesale and retailing of textile and clothing, and the defendant is a company engaged in manufacturing and selling textile products.
The Plaintiff entered into a contract for the supply of sampling and export of raw material supplied by the Plaintiff, supplied the Defendant with the sample of KRW 11,437,813, and entered into a contract with the Defendant to export original material over three occasions as follows:
On September 22, 2017, the Plaintiff of the first unit shipment issued a commercial invoice on the item CDYD KRBRIC volume 76,183 , 162,269.79 US$ (Korean Won 186,074,768). On September 25, 2017, the Plaintiff loaded the first unit on September 25, 2017.
(hereinafter referred to as “the primary unit”). The primary unit, which was loaded, arrived at the Jaza port on October 3, 2017, was delivered to D (hereinafter referred to as “D”) designated by the Defendant, after passing through the Indonesian Customs Office on October 4, 2017.
On September 29, 2017, the Plaintiff of the second unit shipment issued a commercial invoice on the item CDYD KRBRIC volume 43,747 GNITIC volume, USD 93,181.11 (Korean US$ 106,850,779) and loaded the first unit on October 6, 2017.
(hereinafter “2nd raw group”). The second raw group, which was loaded, arrived at the Indonesia Scar on October 14, 2017, passed through the Indonesia Customs on October 17, 2017, and delivered to D.
On October 13, 2017, the 3rd unit shipment and the non-delivery Plaintiff of the bill of lading issued a commercial invoice on the item C DYD KRD 79,480 US dollars 169,292.40 US dollars 169,292.40 (Korean Won KRW 191,926,793) and loaded the above original invoice on October 15, 2017.
