Defendants are not guilty.

1. Summary of the facts charged

A. Defendant A is a member of the Forestry Cooperatives Association in the YA and the said Union is a person in charge of D’s field who received orders from the YA and proceeds from the Gangwon-gu Armed Forces C.

The Defendant had a duty of care to prevent accidents in advance by setting the shelter route and place of shelter in order to avoid the unexpected direction while managing, supervising, and cutting down the safety and working conditions of the tree workers as a field manager at the above-site and implementing safety measures, such as removing obstacles, etc. in order to avoid the use of trees in an unexpected direction.

Nevertheless, the Defendant, at around 08:30 on February 6, 2014, left the scene without supervising the sprinking operations conducted in the above field, and was negligent in preparing a representative election at the office of the above union, and the victim E (the aged 62) who was one of the workers of the sprinking operations was sprinked without the way of evacuation and the place of evacuation, and led two parts of the victim to be sprinked.

Ultimately, the Defendant caused the death of the victim due to occupational negligence, which did not take safety measures as above, due to the death of the victim from the same place.

B. The Defendant, the Defendant, the Defendant’s employer of the Forestry Cooperatives, did not take safety measures as above, resulting in the death of the victim.

2. The following circumstances acknowledged by the evidence duly adopted and examined in this Court, namely, the instant accident did not use the trees expected to be another tree on the surface, and the trees that were supported differently from the expected to be sprinked to the sprinked to the sprink, and it was covered by the victim at the sprink, and the Defendant A did not directly set the shelter route or the shelter site at the time but did not directly set the shelter route or the shelter site.
