1. The Defendant shall pay to the Plaintiff KRW 218,915,00 and the interest rate of KRW 15% per annum from August 5, 2015 to the day of complete payment.

Reasons

1. Facts of recognition;

A. The Plaintiff is a management body representative of the instant building as the Pullet Korea Up-to-date store (which is an underground second and fifth floor condominium building building; hereinafter “instant building”) located in Gwangju Mine-dong 688-4, and the Defendant is a company that aims at the creation of housing sites and the sale of housing units.

B. The Defendant is the owner of the second floor Nos. 222, 250, 251, 252, 312-2, and 502 of the third floor among the instant building (hereinafter “Defendant-owned commercial building”).

C. On August 24, 2006, and November 8, 2006, the Defendant: (a) designated Korea Asset Trust Co., Ltd. (hereinafter “Korea Asset Trust”); (b) Incheon Mutual Savings Bank for Priority Beneficiary; (c) and (d) 101, 103, 104, 105, 106, 110, 111, 112, 113, 114, 116, 117, 122, 125, 130, 140, 145, 146, 207, 207, 30, 234-24, 27, 27-4, 27, 37, 30, 274, 274, 275, 274, and 37, 30, 274, and 47, and 27.

The provisions concerning the preservation and management of trust real estate in the trust ledger which is bound in the register of the building of this case, attached to the application for registration of this case shall be as follows:

Article 9 (Preservation, Management, etc. of Trust Real Estate) (1) A truster shall actually continue to occupy and use trust real estate, and shall substantially preserve and all of the trust real estate.
