A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On May 30, 2008, the Defendant was issued a summary order of KRW 1.5 million for a crime of violating the Road Traffic Act at the Suwon Flag Flag, and on March 12, 2010, the Defendant was issued a summary order of KRW 2.5 million for the same crime at the same court.

[Criminal facts]

1. The Defendant in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents is a person engaging in driving a B car.

On April 11, 2016, the Defendant driven the said car under the influence of alcohol level of 0.064% from blood alcohol level around 18:55 on April 11, 2016, and proceeded at a speed of about 20 km in the speed of Si/Gun/Gu depending on the two-lanes of gold household distance from the front side of the gold-ro, gold-ro, gold-ro, gold-ro, gold-ro, gold-ro.

Since there is an intersection where signal lights are installed at the front of that place, there was a duty of care to reduce the speed to those engaged in driving of a motor vehicle and thoroughly drive the steering system and prevent accidents in advance by operating the system accurately.

Ultimately, the Defendant suffered, by such occupational negligence, the injury to the above victim C, such as a light clocked signboard, etc., which requires approximately 6 weeks of treatment, and the injury to the victim E (V, 47 years of age) who was on the flock vehicle, such as clocks, tensions, etc., which require approximately 2 weeks of treatment, and the victim F (V, 54 years of age) with the clocks and tensions that require approximately 2 weeks of treatment.

2. On April 11, 2016, the Defendant violated the Road Traffic Act (driving of alcohol) from around 8 km to the place specified in paragraph (1) of this Article, which is located in the enclosed-dong at the time of impulseing on April 11, 2016.
