1. The Defendant: (a) KRW 110,00,000 for the Plaintiff and 5% per annum from November 16, 2015 to October 26, 2016; and (b) the Plaintiff.
Reasons
1. Facts of recognition;
A. Pungsung Housing Co., Ltd. (hereinafter “Pungsung Housing”) and gardening Industries Co., Ltd. (hereinafter “Pungsung Industries”) jointly carried out apartment construction projects (hereinafter “instant project”) within the period of Pakistan, and purchased the project site.
B. On December 16, 2003, the Defendant entered into a sales contract with respect to D prior to D,580 square meters, E, 426 square meters, and F, 179 square meters (hereinafter “each of the instant lands”) with respect to each of the instant lands owned by the Defendant, as follows:
(hereinafter “instant sales contract”). The purchaser column of the instant sales contract signed and sealed a scenic house, and the gardening industry was signed and sealed as a joint executor at the bottom of the contract.
The real estate sales contract (hereinafter referred to as the "A") and the buyer's Pungsung Housing and the joint executor's gardening industry (hereinafter referred to as the "B") shall be called as follows, and the sales contract for each land of this case shall be concluded as follows and the contents of the contract shall be implemented on the basis of mutual trust and good faith.
Article 1(Purpose of Contract) In order to purchase each of the instant land owned by “A” and to build urban development projects and multi-family housing in the entire project site within the additional cadastral map (hereinafter referred to as “project site”), the “B” and “B” enter into a sales contract through mutual consultation.
Therefore, the contents of each section of this contract are for the purpose of constructing multi-family housing and neighborhood living facilities.
Article 2 (Sales Price and Payment Method) The purchase price of each of the lands of this case is KRW 1,086,750,000, and the down payment is KRW 110,000,000 within 30 days from the date of completion of the purchase of the land subject to the project, and the balance is KRW 976,750,000 within 45 days from the date of completion of the project approval.
The part payments in the contract are paid within 30 days after the approval of the business, and the part payments are paid within 15 days after the payment of the part payments.
