1. The defendant,
A. On December 12, 2007, with respect to each of the shares listed in the separate sheet Nos. 1 through 4 to Plaintiff A, a sale is made on December 12, 2007.
Reasons
1. Basic facts
A. The building of 233.2 square meters in Yangcheon-gu Seoul Metropolitan Government (hereinafter “instant land”) and the 2nd floor thereof (hereinafter “instant building”) were installed at a store and a street store, and were used in the F market. However, the Defendant owned 62, 63, and 64 stores of 1st floor among the said F market and 31, 32, 41, 42, 43, 44, 58, and 60 units of 1st floor.
The details of the registration of transfer of ownership completed under the name of the defendant as to the land of this case are as follows.
Serial No. 63 of the 1st and 1st and upper-tier store (Attached Table 1), 63 of the 1985, Nov. 22, 1985 (Attached Table 89), 16.10 2/2 of the 16.102th and upper-tier store (Attached Table 2), 16.10/2 of the 2333.2 of the 16.3rd and upper-tier 31, 32 (Attached Table 34 No. 46. 943, Jun. 28, 1985), 23.3 of the 93rd and upper-tier 46.3 of the 193rd and upper-tier 94, Jan. 8, 1987 (Attachment 101), 9.24 and 58.3/1924 of the 193rd and upper-tier 25.3 of the 193rd and fourth-class 13/194 of the 193rd 25.25.23
B. However, around January 10, 200, in order to remove the instant building and construct a new main complex building, the F market reconstruction and improvement project cooperative (hereinafter “cooperative”) consisting of the owners of the instant land and the instant building was established. On October 4, 2005, the Defendant completed the registration of ownership transfer on the ground of trust with respect to the entire shares owned by the Defendant (hereinafter “instant shares”) out of the instant land in the future of the said cooperative. The instant building was demolished around February 2007.
C. On December 12, 2007, Plaintiff C and the Defendant on behalf of the Plaintiff on December 12, 2007, respectively indicated in [Attachment 1-4] Nos. 63 and 64 of the first floor store and No. 31, 32, 41, 42, 43, and 44 of the actual subject matter trusted with the Defendant.
