1. The Defendant’s KRW 14,350,00 for the Plaintiff and KRW 5% per annum from August 13, 2016 to August 14, 2018.
Reasons
1. The plaintiff's assertion
A. The Plaintiff completed all of the following construction works by being awarded a contract with the Defendant:
B. The sum of each of the following construction costs is KRW 105,635,326. Of them, the unpaid construction cost is KRW 40,185,326, which is paid only KRW 65,450,00, but has been reduced in part, and the Plaintiff seeks payment of the remainder construction cost and interest for delay thereof to the Defendant.
(1) From among the new construction of a factory in Ycheon-si on February 29, 2016, the construction cost of which is KRW 32,00,000 and KRW 51,950,00 of the interior works shall be adjusted as follows: (1) Of the new construction of a new building in Ycheon-si on February 29, 2016, the Plaintiff shall be paid KRW 32,00,000 and KRW 51,950,000 among them shall be paid by the Defendant; (2) the remaining construction cost of KRW 14,350,000 shall be reduced by the Plaintiff himself; (3) the additional construction cost of KRW 30,00 shall be reduced by KRW 14,350,00 for the remaining construction cost; (4) the additional construction cost of KRW 30,000,000 for Y-gun-gun Special Metropolitan City on April 20, 2016; and (3) the additional construction cost of KRW 30,5000,000.
2. Determination
A. In full view of the purport of the arguments in the evidence Nos. 1-2, 6, 7, 8, and 9 as to the claim for construction price, the Plaintiff is a person engaged in construction business under the trade name of “J”, and the Defendant is a person who runs the trade name of “K”. On February 29, 2016 between the Plaintiff and the Defendant on February 29, 2016, the Plaintiff substituted the construction price of KRW 32,000,000 as to the “construction and sanitary installation works” among the instant construction works, and the down payment of KRW 10,00,000 as the contract deposit, the remainder payment for the remainder after completion, and the additional electricity and equipment after completion inspection.
