A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
On November 2, 2011, the Defendant sentenced the Incheon District Court to two years of imprisonment for a crime of fraud. On January 31, 2012, the same court was sentenced to six months of imprisonment for a crime of fraud and completed the execution of the final sentence on November 30, 2013.
1. On July 21, 2015, the Defendant posted a letter “D” bank located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, “D” on the Internet NAVVER Roster bulletin board, and promised to send the victim E who reported and contacted this letter to the PIN (personal identification number: personal identification number; hereinafter “PIN”) number when sending it to the victim E.
However, in fact, there was no intention or ability to deliver goods even if the said victim received merchandise coupon numbers from the said victim.
At around 20:50 on the same day from the victim E, the Defendant, by deceiving the victim as above, received three (F, G, and H) of the PIN number 10,000 won of the fake cultural product PIN number 3 (F, G, and H) and acquired pecuniary benefits equivalent to KRW 30,000.
2. On August 17, 2015, the Defendant sent KRW 200,000 to the Internet NAVER bulletin board around the PC station located in Bupyeong-gu, Bupyeong-gu, Incheon, Incheon, in order to send the gallon-based 3 pagogs after checking the deposit, if the Defendant sent KRW 20,000 to the Internet NAV.
After posting the phrase "," the victim I who reported and contacted this article promised to sell the goods normally.
However, in fact, there was no intention or ability to deliver goods even if the victim received money from the said victim by posting a false letter.
The Defendant, as above, by deceiving the victim I, received KRW 200,000 from the victim to the Agricultural Cooperative Account (K) in the name of J around 16:43 of the same day.
3. The Defendant: (a) around August 25, 2015, at the PC room near the vice-dong, Bupyeong-gu, Incheon; (b) Internet NAVER; and (c) Internet NAVER in the vicinity of the vice-dong, Bupyeong-gu, Incheon.
