Reasons
Punishment of the crime
The defendant is a person who engages in food sales business in the 'C' located in Jeonju-si B.
No person who produces, processes, ships, sells (including mail order sales) agricultural and fishery products prescribed by Presidential Decree or the processed products thereof, or stores or displays such products for the purpose of sale shall place a false place of origin labeling or place a mark likely to cause confusion with such products.
Nevertheless, from August 1, 2013 to July 15, 2014, the Defendant purchased approximately 455 km 19,500 g for each box of 19,500 won or KRW 20,000 for each box of 19,50 g for 19,500 or KRW 8,986,250.
From August 29, 2013 to July 15, 2014, the Defendant sold quachi manufactured in China, and indicated the proper origin in the quachi box, but the trading statement made a false indication of the origin of quachi and the possibility of confusion with the domestic origin.
During the above period, the Defendant indicated the origin as above and sold 282 2,820 gg, market price of 7,332,00 won to an I restaurant located in YY-gu, YY-gu, YY-si. For the same purpose, the Defendant violated the Act on Origin Labeling of Agricultural and Fishery Products by storing the amount of KRW 10 g, the market price of which is 26,00,00 in the 45 marchi 455 marchi manufactured with the red red powder powder in China, and the amount of KRW 26,00 in the marchi in the business place.
