Reasons
Punishment of the crime
On August 31, 2007, the Defendant was issued a summary order of KRW 700,000 as a fine for a violation of the Road Traffic Act by the Suwon District Court.
On July 3, 2019, the Defendant, as a person who violated the prohibition of drunk driving regulations, drives a Dbee truck in the state of under the influence of alcohol 0.074% in the section of approximately 6km from the 6km of blood alcohol level to the road before the “Cmiddle School” located in Suwon-si Line B, Suwon-si.

The reasons for sentencing under Article 334(1) of the Criminal Procedure Act of the provisional payment order include a history of punishment once for drunk driving in 2007, but is relatively old and there is no other penal power. The fact that blood alcohol concentration at the time was not high, human and physical accidents did not occur, and other factors of sentencing indicated in the records and arguments of this case, such as the defendant's age, character and behavior, career, environment, circumstance and consequence of the crime, circumstances after the crime, etc., shall be determined as ordered by taking into account all of the sentencing conditions indicated in the records and arguments of this case.
