1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
Basic facts are as follows: (a) on September 3, 2007, the Plaintiff obtained a certificate of qualification as the head of a nursery and serves as the head of C Child Care Center (hereinafter referred to as “Child Care Center”).
The instant childcare center was certified by the Minister of Health and Welfare from November 1, 2012 to October 31, 2015 by the Child Care Center.
In around 2010, the Plaintiff entered into a contract with the Korea Foreign Language Institute for Special Activity English Education with the Korea Foreign Language Institute, which is a provider of the special activity program (referring to the activity program by external instructors other than the child care program by age according to the standard infant care process), and entered into a contract with the D company for the supply of the special activity program with the E company.
Since July 2013, the commissioner of Jeju Special Self-Governing Province (the commissioner of Jeju Special Self-Governing Province) started an investigation on the illegal collection of special activity expenses against Jeju child care centers, kindergartens and special activity providers, and notified the defendant of the following investigation results in relation to the plaintiff on September 23, 2014:
In February 2010, the Plaintiff entered into a supply contract with the Korea Foreign Language Institute, which is a provider of special activities programs for the Staff of February 1, 2010, to set the activity expenses for English special activities at KRW 8,182 per person for each child under the age of 5,857 per month for the children under the age of 6,000, KRW 20,636 per month for the children under the age of 5,000, and KRW 7 for the age of 5,587 for the children under the age of 4,00 per person for the children under the age of 3 to 7,000, KRW 30 for the children under the age of 15,00 for the children under the age of 5,50 for the children under the age of 5,00 for the children under the age of 5,00, KRW 100 for each child under the age of 60 for the children under the age of 3 to 7,50 for the children under the age of 1.
