1. Defendant A shall be punished by a fine of KRW 2,00,000.

When the defendant does not pay the above fine.

Punishment of the crime

1. Defendant A is a certified broker operating “N official brokerage office” in Seo-gu, Gwangju, Seo-gu.

No certified brokerage agent for commencement of business shall receive any remuneration for brokerage of objects other than housing under any pretext, such as cases, donations, etc., in excess of the office remuneration rate prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.

Nevertheless, on June 18, 2015, the Defendant received money in excess of KRW 225,000,000,000,000,000,000,000 from a seller, Q Co., Ltd., and the buyer, by receiving KRW 500,00 from a buyer on July 29, 2015, the Defendant received money in excess of KRW 225,00,00,00,000, which is the upper limit of statutory fees.

In addition, until February 13, 2016, the Defendant received money in excess of KRW 1,2730,000,000,000 from each of the 16 instances, as shown in the list of crimes, and received money in excess of KRW 8,99,00,000 from the statutory fees.

2. Defendant B is a certified broker who operates the “T Authorized Brokerage Office” in Gwangju Northern-gu S.

No certified brokerage agent for commencement of business shall receive any remuneration for brokerage of objects other than housing under any pretext, such as cases, donations, etc., in excess of the office remuneration rate prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.

Nevertheless, on July 17, 2013, the Defendant: (a) arranged a contract to sell an officetel of an amount equivalent to KRW 45 million in the value of U. 45 million in Seo-gu in Gwangju, Seo-gu to a seller Q Co., Ltd.; (b) received payment of KRW 500,000 from a seller’s agent C on July 29, 2015; and (c) received money from the seller’s agent C in excess of KRW 405,000,000 equivalent to the upper limit of statutory fees.

The Defendant, from September 24, 2015, received a total of KRW 36.5 million from 37 times to 37 times, as shown in the second list of crimes committed.
