A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The Defendant, from March 2012 to March 2012, 2012, operated the Company as the operator of the “D”, which is a cargo transport company in the East Sea C, by paying the cost of cargo transport after about 45 days from the month when the trucking service provider requested the freight transport service.

1. On June 2014, the Defendant sent the same attitude that the Defendant would normally pay the freight transport cost to the victim E by telephone to the victim E by the telephone.

However, from May 2014, the defendant had no intention or ability to pay the price normally even if the victim has attempted to pay the price for the cargo in an economic difficult situation such as not giving the price to the customer in the course of the operation of the company.

Nevertheless, the Defendant, as above, by deceiving the victim and allowing the victim to perform the freight transport work requested by the Defendant on or around June 2014, and taking property profits equivalent to KRW 2,243,449, a sum of 68,109,218 won from the above date to July 2014, the Defendant acquired the pecuniary profits as shown in the attached Table 1.

2. The Defendant: (a) within the D office located in the East Sea D in the East Sea B, the victim F was “to pay transport charges after two months from the date of the transportation of the cargo as the passbook” to the victim F; (b) from that time, the Defendant requested the transportation of the cargo from May 2014 to May 2014; and (c) paid the transport charges normally.

On June 2014, the defendant sent the same attitude that the victim would normally pay the cargo transport cost to the victim at the above office, and requested the cargo transport work.

However, in fact, even if the defendant requests the victim to perform a cargo transport work in an economically difficult situation like the statement in Paragraph 1, the amount shall be paid.
