A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Despite the fact that the Defendant is not a person with a psychotropic drug residing in the Republic of Korea, the Defendant dealt with the psychotropic drug psychotropic drugs-related Melopon (one philopon; hereinafter “philopon”).

1. On October 15, 2018, the Defendant: (a) from around 10:00 to around 11:00 on October 15, 2018, to around 11:00 on the same day, paid KRW 5 million in the future to D (D, one name “E”; hereinafter “D”); and (b) from each of them paid 10 plastic bags containing a non-fluoron ($ 0.5g/ oneg).

On October 17, 2018, the Defendant received a request from the above D to return five of the 10 vinyl paper containing a non-finite finite, which the Defendant received from the above D, from 21:00 on the same day to 22:00 on the same day, the Defendant sent five of the above vinyl BD paper to D through a "F" during the period from 21:00 on the same day, and then paid KRW 2.5 million on the end of the same month.

Therefore, the defendant received five plastic bags containing a non-fluoron, and purchased five plastic bags with a non-fluoron, and purchased five plastic bags with a non-fluoron in 2.5 million won and purchased five plastic bags with a non-fluoron.

2. 필로폰 투약 피고인은 2018. 10. 15. 11:00경부터 같은 날 12:00경까지 사이에 화성시 G 소재 H 기숙사에서 불상량의 필로폰을 투약기구(속칭 ‘그라뻥’, 필로폰을 가열시켜 발생하는 연기를 모아 흡입할 수 있도록 해주는 기구)에 올려놓고 라이터로 가열하여 발생한 연기를 흡입하는 방법으로 필로폰을 투약한 것을 비롯하여 그때부터 2018. 10. 하순경까지 사이에 같은 장소에서 약 10여회에 걸쳐 같은 방법으로 중량 불상인 비닐봉지 5개 분량의 필로폰(합계 2.5그램 ~ 5그램)을 투약하였다.
