2. Judgment on the prosecutor's assertion of mistake of facts

A. The summary of this part of the facts charged reveals that the Defendant was in bad credit standing due to the overdue charge of KRW 5 million and credit card payments, etc., 5 million from the Savings Bank around March 4, 2014. On July 2014, the Defendant borrowed KRW 13 million from the J, which was the operator of the D farm, and paid KRW 5 million from the victim E, who was the operator of the D farm, paid the remainder of KRW 8 million, but J urged the Defendant to pay the Defendant a full payment before he left the D farm and received considerable stress, with the intent of raising the money to deduct part of the pigs raised from the D farm.
