Reasons
1. The parties' assertion
A. The Plaintiff’s assertion (1) is the owner of the printed machines listed in the separate sheet of movable property (hereinafter “the instant printed machines”) and used by Seongdong-gu Seouldong 2 at 70 square meters underground floor of 284-37 U.S. Building (hereinafter “instant office”). On August 24, 2012, the Plaintiff purchased the instant office at KRW 200 million, and paid KRW 200 million on the day of the contract to scarca, and acquired the ownership or the right of transfer on the instant printed machines or the right of transfer on the same day by obtaining the possession transfer by the method of occupancy amendment by consenting to the use of the instant office by June 2013.
(2) The grounds for the Plaintiff’s purchase of the instant print machines are as follows.
In other words, the printing machines of this case were leased and used by the Defendant from the T.S. Asset Management Co., Ltd., a facilities leasing business entity under the Specialized Credit Financial Business Act (hereinafter “Lease”), and purchased and delivered the instant machines from the Defendant on May 31, 201, prior to the expiration of the above lease term. At the time, the owner of the instant printing machines purchased the instant machines from the Defendant on May 31, 201, prior to the expiration of the above lease term. At the time, the owner of the instant printing machines received delivery of the instant printing machines by the Defendant’s disposal act, an unentitled S. S. S. S.C., upon the expiration of the lease term on February 16, 2012, the printing machines transferred the instant printing machines to the Defendant. Accordingly, on the same day, the printing machines was owned by S.C. and purchased from S. on August 24, 2012, the genuine owner of the instant printing machines on the basis of ratification of the management of S.S. assets.
