All of the plaintiff's claims are dismissed.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Basic facts
A. The status of the party is that the Plaintiff is a wholesale and retail business of construction materials; Defendant C is a licensed real estate agent; Defendant B was a licensed real estate agent assistant working in the office of the licensed real estate agent of Defendant C and the representative of D Village Council.
B. On August 18, 2010, the Plaintiff purchased each land E and F (hereinafter “each of the instant land”) as the intermediary of the Defendants, and completed the registration of ownership transfer under the Plaintiff’s name on August 24, 2010.
C. On January 2, 2013, the Plaintiff is an applicant for the D Village Association, and the Plaintiff is an applicant for each of the instant land owned by the Plaintiff, one warehouse for the purpose of a village joint workplace, which is a type 1 neighborhood living facility with a building area of 60.8 square meters on each of the instant land owned by the Plaintiff (hereinafter “instant building”).
(2) The instant building was completed on November 6, 2013, and the registration of preservation of ownership was completed in the name of D Village Association on November 18, 2013, and on the same day, a real estate sales contract was formulated with the purport that the Plaintiff purchases the instant building from D Village Association KRW 296 million from the purchase price.
3) As a result of the completion of the instant building, the land category of each of the instant lands was changed from “the answer” to “the building site. 4) On December 30, 2013, the registration of transfer of ownership was completed on the ground of sale as of November 18, 2013 in the Plaintiff’s name.
5) In return for the above development activities, the Plaintiff paid KRW 30 million to Defendant B around February 8, 2013, and KRW 290 million around December 30, 2013. D. Criminal judgment became final and conclusive 1) The Plaintiff and Defendant B were indicted for obstruction of performance of official duties, violation of the Act on Special Measures for Designation and Management of Areas of Restricted Development, and Suwon District Court’s Sungnam branch was convicted of the Plaintiff and Defendant B on April 8, 2015.
