Defendant shall be punished by a fine of KRW 5,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. On January 2010, the Defendant accepted the proposal of “B” from the person “B” at a coffee shop where the trade name located in Yeongdeungpo-gu Seoul, is not known to the police officer, with the intention of “five million won in return for the false entry into the Republic of Korea of Vietnam,” such as the false entry into the public electronic records, etc., and the false entry into the public electronic records, etc.
Around February 11, 2010, the Defendant: (a) made a false marriage report as if he/she had no intention to marry with Vietnam women C, and (b) submitted to the public official in charge of family relationship registration who is aware of the fact to record false facts in the family relationship electronic information system, which is a public electronic record; and (c) had the public official in charge of family relationship recorded such facts at around that time.
Accordingly, the defendant conspireds with B to enter false facts in public electronic records, and exercised them.
2. No person who violates the Immigration Control Act shall apply for a false visa or a visa issuance certificate, or assist such application to allow any foreigner to enter the Republic of Korea;
On February 11, 2010, the Defendant received the proposal of the above B and filed a false marriage report with the above C in the same manner as the preceding paragraph, and was well aware that the purpose of entry into the Republic of Korea was employment. However, around that time, the Defendant obtained a marriage relation certificate, family relation certificate, etc. necessary for applying for a visa for entry into the above C and delivered it to B, and the above C received it, and on March 12, 2010, the above C applied for a false visa issuance application, accompanied by the above marriage relation certificate, etc.
Accordingly, the Defendant conspireds with B and C to enter the Republic of Korea, thereby making a false visa.
