1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff is a company established on May 23, 2012 for the purpose of research and development of natural byproducts and bioscopic eggs and production and distribution business, and the Defendants are engaged in the wholesale and retail business.
B. 1) The Plaintiff’s in-house director K entered into a contract for the supply of functional biotechnology 1) The Plaintiff’s in-house director, as well as L/he engaged in the same business as L/he has developed a cather feed additives for raising, and established the Plaintiff in order to promote the sales business of “functional bio-cat (hereinafter “the instant column”). The Plaintiff and the Defendants entered into a contract for the supply of the instant column with the following content on July 22, 2012.
(B) In the following contract, “A” and “B” respectively refer to the Defendants, and “A” and “A” Article 1 (Supply) of the same Act provide the following: (a) thorough farm management; (b) timely supply of quality eggs to B; and (c) the date and place shall be determined by mutual consultation.
Article 3 (Quantities and Types) (1) Quantity: In principle, Gap shall transport two times a week x 3,500 x 3.5 tons x 3.5 tons a week x 3,500 x 4 times a week from six months to one week x 3,500 x 30 x 3.5 tons a week (6 months a day).
(2) Types: A may provide B with and sell to B various kinds of products (M 10 inputs, 15 inputs), including six entrys, 20 entrys, 25 entrys, and 30 entrys.
The ownership of the product design under Article 4 (B) is for A, and there is no separate product design nor similar design for B.
However, if it is necessary to modify a design in order to enhance the brand of a trademark, it may be requested to A.
Article 6 (Roti and Eination) (1) Eul shall purchase the whole quantity of royalties following the supply of functional butane eggs to Gap, and shall pay 15 won per 15 (10 cases 150 won per 1).
