A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant had no intent or ability to repay money to a bank without a certain property, even if he/she lives with a bad credit holder and borrows money from others in the course of operating entertainment centers in the name of "D" in the South old-gun C.

1. On August 20, 2012, the Defendant committed a crime against the victim E with a false statement that “only three million won is required to operate main points, and only two-3 months will be used and repaid if the Defendant borrowed money.”

However, even if the defendant borrowed money from others as above, he did not have the intent or ability to repay it.

Accordingly, the Defendant, as such, was informed of the victim and received KRW 3 million from the victim on the same day, and received KRW 13 million in total on two occasions, such as the list I of the crimes committed in the attached Table.

2. On April 22, 2013, the Defendant against the victim G made a false statement to the victim that “The Defendant would have the victim repay within a number of days if he/she lent 10 million won to the Defendant with the employee accommodation who works at the main office with the Defendant’s house located in the Gunam-gun H.”

However, the defendant did not have any intention or ability to pay the money, even if he borrowed money from others on the same ground as the facts stated.

Accordingly, the Defendant, as such, was issued KRW 31 million in total on six occasions, as shown in Appendix II, including by deceiving the above victim and receiving KRW 10 million from the victim.

3. Fraud against victim I;

A. On October 12, 2012, the Defendant made a false statement to the victim I’s house in the case of the victim I, who is in the case of the former Gue-GunJ, stating, “I will repay 5.7 million won to the victim within a prompt time when I lent 5.7 million won to be repaid with the main operating fund within the internal jurisdiction.”
