Reasons
Punishment of the crime
The Defendant is a person who, around July 29, 2016, purchased a “E” insurance for a five-year period of time in relation to the maintenance of victim D insurance vehicles and the occurrence of accidents during the trial run, while running a mutual motor vehicle maintenance business in Gangnam-gu Seoul Metropolitan Government B, and F is a person who operates a motor vehicle maintenance business with the trade name of “H” from Macheon-si G.
1. On February 7, 2017, the Defendant: (a) accepted the I Benz’s car in the above C at the time of operating the Ienz car in the vicinity thereof; (b) the engine engine was faced with the road floor; (c) around February 17, 2017, the Defendant demanded F to pay insurance money in an amount equal to the actual cost of repair in order to receive a large amount of insurance money for the car repair; and (d) F to receive insurance money in excess of the actual cost of repair by accepting it.
F even though the actual repair cost of the said benz car was equivalent to KRW 9,300,000,000, around February 21, 2017, the F issued a repair estimate as if the repair cost was approximately KRW 2,014,00,000, and the Defendant claimed insurance proceeds from the victim on February 28, 2017.
Around August 29, 2017, the Defendant and F conspiredd the victim, thereby deceiving the victim, and then, transferred 16,30,000 won of insurance money under the name of benz car repair cost to the Defendant’s account under the name of the Defendant, thereby deceiving approximately 6,730,000 won, which is the difference between the actual repair cost and the actual repair cost.
2. On August 16, 2017, the Defendant’s fraud related to the golf car repair cost, while repairing the J golf car in the above Section C, was involved in the accident that the golf car fells from the offline to the bottom of the maintenance set, and on August 18, 2017, reported the accident to the victim on August 18, 2017, and on August 22, 2017, accepted the car “F with the vehicle’s accident repair.”
