Reasons
Punishment of the crime
1. A person shall not damage, alter, or forge an information and communications system, data, program, etc., or deliver or spread a program that is likely to obstruct the operation thereof (hereinafter referred to as “malicious program”) without justifiable grounds, and shall not damage another person’s information processed, stored, or transmitted through an information and communications network, or shall not infringe, appropriate, or divulge another person’s confidential information.
On February 2016, when the Defendant was working as C Research Institute in the Si of Sungnam-si, the Defendant: (a) received a certain price (the first 500,000 won) from D in early 2016, and (b) received from E, an Internet game site, to a computer, etc., created a malicious program that prevents the other party from viewing the other party’s plaque; (c) received a request to create a malicious program that prevents the other party from viewing the other party’s plaque; and (d) stored “G” files, which are the above malicious program, in the Defendant’s room located in Seoul F, at the Defendant’s room, stored the same music program, and then stored them in the USB, and then sent the files to D, 00,0000 won to Japan’s server (IPH and I) managed by D; and (d) changed the name of D, 200,000,000,000 won for the above malicious program, and 5,000,000.
