Reasons
Punishment of the crime
Defendant A and the Seoul Gwangjin-gu Seoul Special Metropolitan City H, who operated “Gmat” in the Seoul Special Metropolitan City, planned to operate a new discount pool in the Seocho-dong at the same time on August 2014, but there was a lack of funds. However, Defendant A’s proposal planned to operate a new discount pool in the Seocho-dong with a view to purchasing and installing a false LED type, which is an internal material necessary for discount pool business, as it appears that Defendant A’s proposal was made by falsely purchasing and installing a loan for installment financing from an installment financing company.
In addition, Defendant A explained the above plan to Defendant B, a construction business operator in the area of common knowledge, and Defendant B first completed the installation work of ED light at Defendant C’s discount line and then removed the above ED light type loan from the installment financing company under the pretext of sale proceeds, and then, Defendant A was installed at Defendant A’s discount line and received additional installment financing loan, and then was finally installed at the new discount line to run the business in the Seocho-dong at the early stage. Defendant A and C participated in the crime.
1. On August 2014, the Defendants conspired to obtain installment financing loans in the name of Defendant C by the aforementioned method as Defendant C, by committing the crime against the victim Samsung Card Co., Ltd. and the victim professional Capital Co., Ltd.
Accordingly, Defendant C prepared, around that time, an application for installment financing with respect to the payment for the purchase and installation of LED type light from Defendant C to the Defendant Samsung Card Co., Ltd. and the Defendant Co., Ltd., the installment financing company, at its “IEt”, and Defendant B installed LE type light on the Matet and sent pictures to the victims after installing the completion certificate of construction and the installation.
The above installment financing company is a installment financing company that actually purchases the goods.
