Reasons
1. Basic facts
A. Eight building owners, including Defendant X,Y, and Z (hereinafter referred to as the above eight owners), are newly built on the ground of the Eunpyeong-gu Seoul Metropolitan Government AJ Forest (hereinafter referred to as “AJ prior to land substitution”) and AK Forest (hereinafter referred to as “AK prior to land substitution”), 197m2 and 397m2 on the ground of 397m2,000 square meters of land before land substitution, and completed the completion inspection on February 10, 1986.
B. The owner of the building constructed a reinforced concrete structure lub crisis and three-story row housing (hereinafter “instant two buildings”) on the ground of 757m2 in Eunpyeong-gu Seoul AL Forest (hereinafter “AL before replotting”) before replotting, and completed the completion inspection on August 25, 1988.
C. The building of this case consists of 18 sections. Since April 1986, the building owner sold the building of this case from around April 1986 to the buyer and transferred the ownership of each share to the buyer as a right to use the land before replotting and AK. Of the building owner, some of the shares of Defendant X, X, Y, and Z were left without transferring to the buyer.
The building of this case consists of nine sections. The building owner sold the building of this case 2 from September 198 to 103, and the building owner transferred the ownership of each share to the buyer before the replotting as a right to use the site. Of the building owner, some of the shares of Defendant X and W among the building owners were left without transferring to the buyer.
E. As a replotting disposition became final and conclusive on December 30, 1988, AL, prior to replotting, was 2.9 square meters in the area below the outer retaining wall of the building of this case, and the parcel number of the remaining part, which is the area below the outer retaining wall of the building of this case, is changed to Seoul Special Metropolitan City, and becomes 734.1 square meters in Eunpyeong-gu Seoul Metropolitan Government (hereinafter “AI”), and it has a share in AL prior to replotting.
