1. The Defendant: 392,950,306 won to the Plaintiff (Appointeds) and 272,700,000 won to the Selection Industries Co., Ltd.
Reasons
1. Basic facts
A. On February 10, 2010, the Defendant concluded a construction contract for the supply and demand of civil engineering works, etc. among the construction works for the creation of a golf course in Kimcheon-si, Kimcheon-si (hereinafter “instant construction works”), and entered into a contract for the modification of landscaping works on October 15, 2010.
B. On March 5, 2010, the Defendant entered into a contract with the Plaintiff (Appointed Party; hereinafter “Plaintiff”) to subcontract civil engineering works, drainage works, and appurtenant works among the instant construction works. The main contents are as follows.
- Construction period: The contract amount: 2,33,100,000 won (the cost of drainage and appurtenant works: 1,651,100,000 won): 2,121,00,000 won (the cost of labor cost of 554,013,463 won, and Article 84 of the Enforcement Decree of the Framework Act on the Construction Industry): 1,50,000 won (the cost of labor cost of 554,013,463 won, and the cost of labor cost of 1,501,00,000 won (the cost of labor cost of 520,652,255 won): Value-added tax,00,000 won (the cost of drainage and appurtenant works: 1,652,00 won) (the cost of installation and appurtenant works: 1,650,000 won)
C. In addition, around March 2010, the Defendant entered into a contract with the Appointer Industry Co., Ltd. (hereinafter referred to as the “Appointed Industry”) to subcontract the instant construction work, and the main contents are as follows.
- Construction period: on March 5, 2010, completed October 30, 2010: Contract amount: 638,000,000 won: 580,000 won (labor cost of KRW 81,064,380, and labor cost of KRW 84,000 under Article 84 of the Enforcement Decree of the Framework Act on the Construction Industry): Value-added tax: 58,00,000 won - Prepaid payment of the price: The completed amount shall correspond to the place of the order:
D. On March 17, 2010, the Defendant entered into a contract with the Selected Construction Co., Ltd. (hereinafter “Appointed Construction”) to subcontract the Phone Construction during the instant construction. The main contents are as follows.
- A construction period: on March 17, 2010, and on October 30, 2010.
