Reasons
Punishment of the crime
On February 13, 2014, the Defendant was sentenced to three years and six years of suspension of the execution of imprisonment with prison labor for special robbery at Daejeon District Court on February 21, 2014, and the said judgment became final and conclusive on February 21, 2014.
Around November 2013, the Defendant received a proposal from C to “I will offer KRW 300,000 per head of a Tong if I want to open a passbook through a person who is aware of the need for the passbook.”
After that, the Defendant, along with D, E, F, G, H, I, J, K, etc., sent to C with the word “the passbook”, and then sent it to D, etc., by obtaining a copy of the company’s personal seal impression certificate corporation register, etc., which does not have any substance from C. D, etc., by directly visiting the bank by using the documents issued as above, and having opened an account under the name of the bank or opened an account under his/her own name and obtain an account creation card (OPT card) of the passbook password, etc., the Defendant sent the passbook to C, even though he/she knew that the passbook, etc. was used for the Bohishing fraud, and C, while he/she knew that the passbook, etc. was used for the Bohishing fraud, and C, “L” and M, etc. distributed the borrowed leaflet, or sent the text message to the phone, and let the person who received the text message deposit money or wired money under the name of insurance premium, thereby inducing the Defendant to do so in the name of the passbook fraud.
1. On November 28, 2013, the Defendant violated the Electronic Financial Transactions Act: (a) around 2013, 34 new bank passbooks (Account Number: Q) and cash cards, etc. received from D in the vicinity of the “O cafeteria” restaurant operated by the mother of C in Busan, Busan, and (b) and (c) from C, as shown in the list of crimes in the attached Table, from that time until April 17, 2014.
