The prosecutor's appeal is dismissed.

1. Comprehensively taking account of the evidence presented by the prosecutor in the gist of the grounds for appeal, the court below acquitted the Defendant on the larceny of the victim’s Nogypt as to the facts charged in this case, although it could be sufficiently recognized that the Defendant committed the theft of the victim’s Nogypt.

2. Determination

A. The summary of this part of the facts charged is between the Defendant and the Victim C’s wife and the wife, and the victim C is the representative director of the “Co. E” (hereinafter “Co., Ltd.”) located in G with the wife population in Young-si.

At around 12:00 on July 19, 2014, the Defendant: (a) stolen the instant company’s ownership of the instant company, holding one of LG XNET North Korea worth KRW 1,029,000, which was placed on the book at the office of the instant company.

B. The lower court determined that the Defendant consistently stated that: (a) the victim C’s words and the current divorce lawsuit had been brought to the police during the divorce lawsuit, and that F had gone to the North Korea with the intent to exchange with the North Korea used by the Defendant (hereinafter “the North Korea of this case”); (b) the Defendant brought a lawsuit seeking divorce, etc. against F on or around May 2014 due to the victim C’s legal marital relationship with F, and (c) on or around July 18, 2014, F brought the Defendant to go to the North Korea used by the Defendant on or around July 19, 2014; and (d) the Defendant sent the letter demanding the return of the above North Korea to F on or around July 19, 2014, which is the date indicated in the facts charged; and (e) the Defendant’s demand for the return of the North Korea to F, which is not the date on which the Defendant reported the said fact to the latter; and (e) the Defendant’s return of the North Korea’s letter to the police.
