The prosecutor's appeal is dismissed.
Reasons
1. The sentencing of the court below (one year of imprisonment with prison labor for a term of six months) is deemed to be too uncomfortable and unfair.
2. The judgment-making vehicles are covered by a comprehensive insurance, and the Defendant agreed at the trial with the victim.
In full view of the various circumstances, including the above circumstances, including the Defendant’s age, character and conduct, environment, family relationship, motive, background, means and consequence of the crime, the sentencing of the lower court is unreasonable.
