1. Basic facts

A. On January 30, 2015, the Plaintiff and D constituted an association and formed a convalescent and jointly operate the building indicated in the separate sheet (hereinafter “instant building”). (hereinafter “Defendant Company”) entered into a contract with the Defendant Company regarding the remodeling project on the first and fifth floors of the instant building (hereinafter “instant construction project”) with the construction cost of KRW 50 million (including value added), and the construction period from February 3, 2015 to May 8, 2015, with the amount of remuneration of KRW 50 million per day designated as the contract price of KRW 1/100,000 per day (hereinafter “instant contract”).

D filed a counterclaim between Suwon District Court 2019 and 13615 on April 22, 2019 between the Plaintiff and D on April 22, 2019 (including the instant construction case). The Plaintiff bears all obligations under the external legal relationship between the Plaintiff and D on January 30, 2015 (including the instant construction case).
