A defendant shall be punished by imprisonment for a term of one year and three months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dangerous Driving) is a person engaging in driving a wing car.
On October 12, 2019, the Defendant driven the above car at around 01:05, and led the two-lane road in front of the D convenience point in Bosung-gun C along the two-lanes in the Bosung-gun, under the influence of alcohol concentration of 0.148%.
At this point, there was an intersection where signal lights are installed, so there was a duty of care to reduce the speed and to drive safely by checking well the right and the right of the driver.
Nevertheless, under the influence of alcohol, the Defendant neglected to perform his/her duty in front of the week while under the influence of alcohol, and due to negligence in failure to properly operate the brake system, the Defendant received the FMW 520d Luxury car operated by the victim E (the 53 years old) in front of the vehicle, and received the part of the Defendant’s vehicle in front of the vehicle.
Ultimately, the Defendant driven the said car in a situation where normal driving is difficult due to influence of alcohol, and suffered injury to the victim G (V, 63 years of age) of the said victim, such as salt, tension, etc. in need of medical treatment for about two weeks, and suffered injury to the victim G (V, 63 years of age) who was on board the said victim’s vehicle.
2. On September 1, 2016, the Defendant received a summary order of KRW 1 million as a fine for a violation of the Road Traffic Act from the Gwangju District Court’s net support on September 1, 2016
The Defendant driven BP wing car while under the influence of 0.148% alcohol level at the time and place set forth in paragraph (1).
Accordingly, the defendant, who violated the prohibition of driving under the influence of alcohol, was driving a car under the influence of alcohol again.
