Comprehensively taking account of the purport of Gap evidence 1-1 and 2-1 and the entire arguments, it is acknowledged that the plaintiff and the defendants jointly own each real estate listed in the separate sheet No. 1 (hereinafter referred to as "each real estate of this case") in proportion to the shares in the separate sheet No. 3, and that the agreement on division has not been reached between the plaintiff and the defendants. Furthermore, in light of all the circumstances, such as the health unit, the area of each real estate of this case, and the use value after the division, it is deemed appropriate to divide the method by auction rather than by the in-kind division.

Therefore, it is decided as per Disposition by deciding to distribute to the original defendant the remaining amount after deducting the auction cost from the sale price by selling each of the real estate of this case at auction.
