1. At around 03:05 on November 14, 2014, the Defendant driven CM7 car under the influence of alcohol with approximately KRW 3 km of alcohol content 0.05% at the entrance distance of the mouth in the same Gu-dong-dong Mabadong-dong, Goyang-si, Goyang-si, the Defendant driven CM7 car under the influence of alcohol with approximately 0.05% at the alcohol level.

2. 판 단 기록에 의하면, ㉠ 피고인이 이 사건 당일 02:50경까지 고양시 일산동구 D에 있는 ‘E’이라는 상호의 술집에서 술을 마신 사실(같은 날 02:51경 위 술집에서 피고인 명의 신용카드로 43,500원이 결제되었다), ㉡ 피고인이 같은 날 03:05경 피고인 승용차량을 운전하여 전 방향 황색 점멸신호 중이던 고양시 일산동구 풍동에 있는 애니골 입구 사거리 교차로를 직진 통과하다가, 피고인 차량 우측 방면에서 직진하면서 교차로를 통과하는 택시차량 앞 범퍼부분과 피고인 차량 좌전반부가 충격한 사실, ㉢ 그로부터 40분 가량 경과한 같은 날 03:45경 피고인의 호흡을 통한 음주측정 결과 혈중알코올농도 0.055%로 측정된 사실, ㉣ 주취운전자정황진술보고서에는 '03.:22경 적발, 술의 종류 및 음주량 맥주 2잔, 언행상태 어눌, 보행상태 정상, 혈색 눈 붉음'으로 기재되어 있는 사실이 인정된다.
