1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The following facts do not conflict between the parties, or are recognized based on Gap evidence 1, evidence 1, evidence 3-1, evidence 3-2, evidence 7-3, evidence 4, evidence 5, evidence 10, evidence 11-1, evidence 13-1, evidence 14-1, and evidence 14-1 to 50, and evidence 6-1 to 16-16, respectively.
A. The Plaintiff is a company established for the purpose of building snow rental business with the trade name of “C”, and the Defendant is a soil construction business established on March 21, 201, and reinforced concrete construction business.
B. The Defendant’s subcontracting Corporation, etc. (1) Construction of Sungju General Construction Co., Ltd. (hereinafter “Maju General Construction”) was a construction project to construct a well-known center building with a total floor area of 22,605 square meters on the second floor above the ground of the 8th floor above the 2nd 8th m3rd m2,605m2 on the ground of the 562-1m3rd m3rd m3rd m3rd m3 (90 m3) of the building of this case, and the construction project to build a golf range on the side of the building of this case (hereinafter “the construction of this case’s additional construction”). The Defendant was awarded a contract for the construction of the building of this case by combining it with the construction of the building of this case to the 562-1m m3rd m3rd m3.
(2) From March 201, D had been in charge of molding construction at the construction site of the instant building from March 201, and E had been in charge of reinforced concrete construction among each of the instant construction works.
C. The Plaintiff, such as the lease of snow materials, provided the building snow materials at each construction site between March 21, 201 and February 27, 2012 upon receiving a request for the lease of the building snow materials from the foregoing D, and thereafter, leased the building snow materials at each construction site. After that, from September 201 to September 201, 201, the structural building construction of the instant building was completed.
