Reasons

1. Details of the disposition;

A. The Defendant is the Eunpyeong-gu Seoul Metropolitan Government Housing Redevelopment Project Association established with approval for the establishment of the association from the head of Eunpyeong-gu Seoul Metropolitan Government (hereinafter “the head of Eunpyeong-gu”) on December 30, 2008 for the purpose of implementing the Housing Redevelopment Improvement Project (hereinafter “instant Project”) by using the total area of 63,168 square meters as the project implementation district.

B. On June 15, 2000, the Plaintiff completed the registration of ownership transfer with respect to D large 361 square meters in Eunpyeong-gu Seoul Metropolitan Government (hereinafter “instant land before the instant partition”) and operated the Ka Center with the trade name “E” on that ground.

On January 26, 2017, the instant land before the instant partition was divided into D large 263 square meters (hereinafter “instant land”) and F large 98 square meters (hereinafter “second-party land”). The instant land was subdivided into F large 39 square meters (hereinafter “instant third land”) and G large 59 square meters (hereinafter “instant fourth land”) on March 30, 2017.

C. On October 19, 2006, the Mayor of Seoul Special Metropolitan City decided to designate the Eunpyeong-gu Seoul Metropolitan City Hdong and Idong as the J urban renewal acceleration district (hereinafter “instant urban renewal acceleration district”), including the land before the instant subdivision, and publicly announced it as K in the Seoul Special Metropolitan City public notice.

On May 22, 2008, the Mayor of Seoul Special Metropolitan City determined a self-urban renewal acceleration plan (hereinafter referred to as the “instant urban renewal acceleration plan”) on the content of designating the area of 63,168 square meters in Eunpyeong-gu Seoul, including the land before the instant subdivision as a Burban renewal acceleration zone (hereinafter referred to as the “instant renewal acceleration zone”), and publicly announced it as L of Seoul Special Metropolitan City.

On September 26, 2013, the Defendant obtained authorization to implement the instant project from the head of Eunpyeong-gu to implement in the instant renewal acceleration zone.

After May 4, 2016, the Seoul Special Metropolitan City Mayor announced by MM on May 4, 2016 shall designate the change of the J urban renewal acceleration district, revise the urban renewal acceleration plan and topographical map.
