Reasons
Punishment of the crime
1. Defendant A is the chairperson of Gangnam-gu, Seoul, and six floors from April 15, 2010 to April 7, 2014, who was engaged in overall management, storage, etc. of funds, such as overall supervision, subsidies, etc. as the chairperson of the victim’s incorporated association C, which was located in Gangnam-gu and Seoul, and B, from March 201 to August 2014, Defendant A is a person who was a director of the corporation from April 15, 2013 to August 2014.
Defendant A, a joint principal offender with B, had the victim corporation manage and keep funds such as subsidies received from the Korea Food and Drug Trade Corporation for the purpose of business, and had the victim corporation use part of the funds for personal purposes, such as the repayment of debts, etc., and had the victim corporation deposited or transferred funds from the account of the victim corporation to the Defendant A or B’s account, etc., and the Defendant B conspired to embezzled funds by depositing and withdrawing funds in accordance with Defendant A’s instructions and handling accounts.
1) On June 24, 201, Defendant A, at the office of the victim corporation located in Seocho-gu Seoul Metropolitan Government, transferred 3,100,000 won from the F Bank account (G) account of the victim corporation to the F Bank account (H) account of B on the same day while he/she kept the funds of the victim corporation, such as subsidies, from the office of the victim corporation located in Seocho-gu Seoul Metropolitan Government for the sake of the victim corporation. Defendant B embezzled 1,100,000 won to the F Bank account of Defendant A, and 1,100,000,000 won to the K Bank account of JJ, and 1,00,000 won to B’s L Bank account (M) account from June 10, 2013 to June 10, 2013, including the payment of debt and food expenses, and embezzled 1,00,000 won to the victim corporation for the total purpose of 17,504,50
