1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On July 22, 2013, the Defendant, as Seoul Central District Court Decision 2013Kadan57436, received a decision on provisional seizure of claims against the garnishee B of the obligor C&D C&DCC (hereinafter “CBC”) and the lease deposit claim against C, and the said decision on provisional seizure of claims reached the third obligor on July 26, 2013.
B. B and C deposited the above lease deposit (hereinafter “instant deposit”) with the Seoul Central District Court Decision 2013No. 19626 on September 16, 2013, and submitted a report on the reason for deposit.
C. On November 7, 2013, the Defendant received a provisional seizure and a collection order to transfer the instant claim for payment of the deposit money to the Republic of Korea as Seoul Central District Court 2013TTTTT35249, based on the original copy of the payment order in the claim for reimbursement of the reimbursement amount case of Busan District Court Decision 2013MT 1047, and the Defendant was served to the Republic of Korea as the garnishee on November 13, 2013.
Accordingly, the deposit officer of the Seoul Central District Court reported the reason for deposit on November 14, 2013, and accordingly, the Seoul Central District Court D distribution procedure was initiated on the deposit money.
E. On the other hand, the Plaintiff was an employee working in C&DCC from December 3, 2012 to September 30, 2013, based on the wage claims not paid from C&DCC, and was determined on November 14, 2013 by Seoul Central District Court 2013Kadan6949 as to the instant claim for the withdrawal of deposit money, and the said decision on provisional seizure of claim was served to the Republic of Korea as the garnishee on November 20, 2013.
In addition, on February 3, 2014, the Plaintiff received a provisional attachment and a collection order from the Seoul Central District Court 2013Gaso8933108, based on the original copy of the judgment of the case, such as wage, etc., (i) the Seoul Central District Court 2014TT2636, to transfer the instant claim for payment of deposit money to the original attachment, and (ii) the said order reached the Republic of Korea as the garnishee on February 7, 2014.
