Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who has entered the Internet file sharing website B with three ID (C, D, and E) and has filed an application for registration of a seller, and works as a trader at the above website.

No person shall infringe another person's work by means of reproduction, performance, public transmission, exhibition, distribution, lending, or preparation of a derivative work of another person.

Nevertheless, around January 5, 2019, the Defendant, at a company G office where the F Defendant is working for the Daejeon Seo-gu Seoul Special Metropolitan City Defendant, connected the above B site to AD’s “D,” and opened the files of “I”, a film work, without the copyright holder H’s permission, using the business-related saw computer in the said B site, provided that the members are downloaded, and 410 points per each Daro 1 are set aside in the said ID.

In addition, from February 12, 2019 to May 2, 2019, the Defendant used ID C to run a cinematographic work on a total of 420 occasions, as shown in the attached list of crimes (1), via IDD during a total of 527 times, as described in the attached list of crimes (2) from January 5, 2019 to July 22, 2019, and by using ID E from February 12, 2019 to July 22, 2019, the Defendant infringed upon the copyright of the copyright holder by engaging in a cinematographic work on a total of 423 occasions without the consent of the copyright holder, as described in the attached list of crimes (3).

No person of "2020 Highest 1319" shall infringe upon any property right or other right protected by the Copyright Act by means of reproduction, performance, public transmission, display, distribution, lending, or preparation of a derivative work without the consent of the person who has such right.

On June 18, 2019, the Defendant committed the crime at around 13:37, Jun. 18, 2019, connected the Defendant’s residence at the Daejeon Daejeon Seo-gu J apartment and K, to AE, an Internet file sharing site, and then, “E” as a cinematographic work for which the Victim L Co., Ltd has exclusive publication right.
