A and B shall be punished by a fine of 2,000,000 won, and Defendant C shall be punished by a fine of 1,000,000 won.

1. 피고인들의 공동범행 피고인들은 2013. 9. 23. 00:05경 광주 서구 E에 있는 F 운영의 G주점에서 생맥주가 맛이 없었다는 이유로 피고인 C은 맥주값을 못 내겠다고 하며 피해자 F에게 기분 나쁜 말로 시비를 걸고, 피고인 A는 종업원인 H에게 “이런 씨발 개 좃 같은 년을 봤나, 이 씨발 년이 말을 좃같이 하네”라고 욕설을 하여 피해자 F이 “손님 이러시면 안됩니다. 진정하십시오.”라고 말을 하자 계산대 안쪽에 있던 컵과 쟁반을 던지며 소란을 피우는 등 행패를 부리고, 피고인 B는 손님인 I의 목을 움켜잡고 맥주 냉장고로 밀어붙여 맥주 냉장고 안에 있던 맥주병 12개를 깨트리고 그 앞에 있던 선풍기를 넘어뜨리고 의자를 들어 폭행하려고 하는 등 약 30분간 소란을 피워 그곳에 있던 손님들을 떠나게 하였다.
