Punishment of the crime

1. Defendant A is the representative of a stock company B in the Southern-gu Seoul Southern-gu Category B, Ulsan-gu, who is responsible for the safety and health management of his employees.

Defendant Co., Ltd. B entered into a contract with Ulsan-gun Co., Ltd., Ltd., Ltd., and, accordingly, the Defendant entered into a contract with the victim F (75 years of age) on June 25, 2019 and carried out a waterproof defect repair work on the roof of the said Co., Ltd.

A business owner has a duty of care to install a work plate in a place where workers fall or are likely to fall or fall, or where workers are likely to pose danger in machinery, equipment, vessel block, etc., by using a complaint work unit, etc.

Nevertheless, the Defendant, on June 25, 2019, caused the death of the victim due to high scarb and pelvis damage to a H hospital located in Ulsan-gun G while the victim felled below the rooftop and was receiving treatment after going to the H hospital in Ulsan-gun G, by negligence, such as using the accusation team, although the victim was at risk of falling down by falling off the container on the rooftop.

2. Defendant B is a corporation that was established for the purpose of painting and waterproofing business located in Ulsan-gu C2, Ulsan-gun, and a business owner who is performing rooftop waterproof repair construction works for a company located in Ulsan-gun D.

Paragraph (1) shall apply to the defendant's business at the time and place specified in paragraph (1) A, who is a person in charge of safety and health management.
