A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On May 3, 2014, at around 14:42, 201, the Defendant: (a) entered the said physical card in a cash payment machine managed by the victim new bank, which is installed at the above 365cc. and then withdrawn KRW 600,000 (one million in cash and five hundred thousand won in cashier’s checks) from the new bank search site at 365ccp of Eunpyeong-gu Seoul on May 3, 2016; (b) transferred KRW 25,000 to the customer by a new bank, which is owned by D; and (c) entered the above physical card in a cash payment machine managed by the victim new bank, which is installed at the above 365cc. and then entered the password.
Accordingly, the defendant acquired financial benefits of 6 million won by inputting information into a computer or any other information processing device without authority.
2. The Defendant embezzled, at the same time and place as described in paragraph 1, without returning the cream card owned by the victim D, while receiving a request from the customer to transfer cash by using the cream card, as described in paragraph 1.
3. On April 2014, the Defendant served as an employee of the 'Frenck’ operated by the victim D in Eunpyeong-gu Seoul, Seoul.
On April 3, 2014, the Defendant: (a) while receiving a microphone of LTS2 mobile phone at the market price so that he/she may use it for his/her duties, he/she embezzled the property of the victim of his/her duties without returning the aforementioned mobile phone on May 3, 2014.
4. On May 23, 2014, the Defendant violated the Resident Registration Act, at HPCs located in Dongjak-gu Seoul Metropolitan Government, presented one of the 50 copies of the cashier’s checks acquired by I as payment for use, and entered another person’s resident registration number (K) on the back of the check.
Accordingly, the defendant used another person's resident registration number unlawfully.
