A defendant shall be punished by imprisonment for four months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

To the extent that it does not substantially disadvantage the defendant's exercise of his/her right to defense, the following facts charged shall be organized and criminal facts shall be recognized:

From around January 201 to early 2015, the Defendant’s “H” as stated in the written indictment of the Victim D Co., Ltd., Ltd., the victim, who is a terlater in the second floor of the Gangnam-gu Seoul Metropolitan building, appears to be a clerical error.

From this point of view, work as a construction site manager.

1. On August 10, 2012, the Defendant: (a) obtained the Defendant’s consent by stating that “the employees need to call up and supply the goods to the extent necessary; (b) as if the Defendant ordered more quantity than the necessary materials, supply the remaining materials to the company; and (c) made a false statement on August 10, 2012, the Defendant made a false statement of relevant documents, such as a demand for the payment of the electric materials infinite amounting to KRW 4 million at the construction site of Yeonsu-gu Incheon, Yeonsu-gu, Incheon; and (d) demanded the victim to pay the price.

Defendant deceiving the victim as above and received 4 million won from the victim to the bank account in the name of I on August 10, 2012, and acquired 4 million won from the victim, and received 15,807,630 won in total on six occasions from the above day to March 13, 2013 through the same method as the previous crime list (1).

2. On March 23, 2013, the Defendant: (a) obtained the consent by stating that “the Defendant shall raise the personnel expenses and request the Company to pay any money to the Company”; and (b) made a false statement in relevant documents, such as a claim for personnel expenses, which is KRW 1,20,000 for the said construction site, around March 23, 2013, to the victim.

The defendant deceivings the victim as above, and thereby deceivings the victim, 10,200,000 won to the bank account in the name of L around March 23, 2013.
