1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. The Plaintiffs are the owners of the motor vehicles indicated in the column for “victims (motor vehicles and vehicle numbers)” in the attached Table of Accident List (hereinafter “victims”) and the Defendant is the insurer who has concluded a comprehensive motor vehicle insurance contract with the owners of the motor vehicles indicated in the column for “Maritime Vehicle Number” in the said table (hereinafter “victims”).
(C) 2. The plaintiffs' assertion on the cause of the claim
A. The primary plaintiffs sustained the damaged vehicle due to the accident caused by the damaged vehicle (hereinafter “each accident of this case”) as stated in the attached Form No. 1.
However, even after repair, there was a non-repairable part, such as the reduction of the use period, function, and aesthetic impairment, and the existence of the accident history, which caused the decline in the exchange value (hereinafter “explosion damage”).
The fall damage is an ordinary or foreseeable special damage caused by a traffic accident.
The plaintiffs requested a professional engineer to conduct an appraisal in order to calculate the amount of loss caused by the decline in the damaged vehicle, and the appraisal cost also constitutes damage caused by each accident of this case.
The defendant is obligated to pay to the plaintiffs the money stated in the "total sum of the claim amount" in the attached Form No. 1, which is the sum of the above amount of loss caused by death and appraisal costs, and compensation for delay.
B. According to the standard terms and conditions for preliminary claim automobile insurance of some plaintiffs, in a case where the repair cost exceeds 20% compared to the value of the vehicle involved in the accident immediately before the date of the release of the accident, 15% of the repair cost, and 10% of the repair cost for a motor vehicle between one year and two years after the release of the accident is recognized as a damage for market price.
