Reasons
Punishment of the crime
[criminal history] On April 16, 2015, Defendant E was sentenced to eight months of imprisonment with prison labor for larceny of a structure intrusion at night at the Incheon District Court, and the judgment became final and conclusive on July 15, 2015.
[2] The Defendants: (a) intentionally received a false accident from an insurance company as if the occurrence of a traffic accident was caused by negligence; (b) received a false accident from an insurance company despite the absence of the occurrence of a traffic accident; and (c) ordered the insurance company to receive a false accident as if the occurrence of a traffic accident occurred; and (d) deceiving the insurance company as if the traffic accident actually occurred, such as the damage of the vehicle or the treatment of the vehicle.
1. Crimes by conspiracy between Defendant A and Defendant B
A. On September 4, 2014, at around 17:40 on September 4, 2014, the Defendants: (a) drive an Ibs vehicle in the vicinity of the Namdong-gu Incheon Metropolitan City, and (b) Defendant B took part of the Jbs vehicle in the above vehicle while driving on the above vehicle; and (c) the above bsts vehicle was damaged to a certain degree; and (d) the Defendants did not have a different place; (b) even though there was no different place, the above bsz vehicle was damaged to a large degree; and (c) the Defendants suffered damage from the above bsz vehicle due to the said traffic accident; and (d) the Defendants were falsely received insurance money from the insurance company from the victim Hyundai Csch Rex accident insurance company around September 15, 2014 to October 30, 2014; and (d) received KRW 10,655,250, and KRW 10,014,000 from the Hyundai Sea Co., Ltd.
B. On March 7, 2015, around 19:05, the Defendants operated Defendant A’s Ienz vehicle in the vicinity of the Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Jeju Island, and Defendant B was driving the said vehicle on the said vehicle, and the said B received the said Benz vehicle as part of the said Benz vehicle, and then the said Benz vehicle was somewhat damaged to the extent of debrising.
