The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. misunderstanding of facts and misunderstanding of legal principles, the Defendant believed that a 300 million fake bill (hereinafter “instant bill”) paid to K side of the victim limited partnership company (hereinafter “victim”) was a genuine bill and delivered the instant bill to the said victim. As such, the Defendant did not have the intent to deception or deception with respect to the fraud around April 25, 2017.

Nevertheless, the lower court found the Defendant guilty of this part of the facts charged. Therefore, it erred by misapprehending the facts or by misapprehending the legal doctrine, thereby affecting the conclusion of the judgment.

B. The sentence imposed by the lower court (ten months of imprisonment) is too unreasonable.

2. The defendant alleged the same purport as the grounds for appeal in the original judgment, and the court below rejected the above argument and found the defendant guilty in this part of the facts charged, with the detailed statement of the defendant's argument and its decision in the sixth through seventh.

In light of the circumstances indicated by the lower court, the lower court’s determination that found the Defendant guilty of this part of the facts charged is justified, and it did not err by misapprehending the facts or by misapprehending the legal doctrine as alleged by the Defendant, thereby adversely affecting the conclusion of the judgment, in addition to the following facts or circumstances acknowledged by the evidence duly adopted and examined by the lower court, namely, ① the Corporation did not commence at the time of receiving the instant bill, and the contact information of W “AB” by the Defendant, who claimed the Defendant to have delivered the instant bill to the Defendant, was the number that had not existed before and after the date of the instant crime, and ② the Defendant did not report the forgery of the instant bill to the police despite the receipt of the victim’s notice of forgery.
