A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

The Defendant, from October 30, 2010 to July 16, 2012, as a person who runs the food manufacturing and processing business under B’s trade name, purchased domestic milk 20,946kg, 7,159kg, total sum of 28,105kg (market price of 196,029,00 won) from D located in Seongdong-gu Seoul Metropolitan Government from October 30, 201 to July 16, 201, and produces and sells stuffed products, namely, sugar, etc.

No one shall make a false indication of the country of origin or make an indication that may cause confusion with agricultural and fishery products, and no one shall make a false indication concerning the nutrition, raw materials, ingredients and use of foods or food additives.

1. On August 4, 2011, the Defendant indicated the origin by falsely indicating the origin in the indication column of the place of origin of the mosium, stating that “Smil oil (Smil oil) and so on” was sold to G located in Gyeyang-gu Incheon City, Incheon, and by August 10, 2012, the Defendant made and sold the mosium 5,59 gambling market price approximately KRW 223,960,000,000, as shown in the attached Table 1-1, as in the attached Table 1-1, by manufacturing and selling the mosium 5,59 gambling market price.

2. Around August 8, 2011, the Defendant falsely indicated the origin in the indication column of the country of origin in the packaging paper of the land in which the land dog was packed by using domestic milk (milch cows) as the material and sold the land dog in a false manner, and by July 28, 2012, the Defendant manufactured and sold approximately KRW 229,775,00 of the land dog market price of KRW 7,070, as shown in the attached Table 1-2, by July 28, 2012, as shown in the attached Table 1-2.

3. The Defendant shall bear a false indication of the origin on August 20, 201.
