A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of a sentence shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 15, 2017, the Defendant posted a letter to the effect that he/she would sell cultural merchandise coupons in the Republic of Korea on September 15, 2017 and falsely sent cultural merchandise coupons to the victim C who reported and contacted with the victim C by sending KRW 1,00,000 to the victim.

However, as the defendant did not have cultural merchandise coupons, even if he received the payment from the injured party, he did not have the intention or ability to send cultural merchandise coupons.

Nevertheless, on September 15, 2017, the Defendant: (a) by deceiving the victim as above; (b) received KRW 1,000,000 from the victim from the victim; (c) and (d) received the remittance of KRW 1,00,000 from the victim’s case bank account (D) on September 15, 2017; and (d) received KRW 1,610,000 from the victims four times from October 13, 2017.

In fact, the Defendant, even though having no intent or ability to sell the goods from the victims even if he received money, posted a letter to sell a game machine, etc. on the Internet and used goods transaction website, and deceiving the victims who reported and contacted this letter four times, and received the total sum of KRW 1,450,000 from the victims to the Korean bank account of the name of the Defendant.

A. On May 13, 2017, the Defendant posted a notice on the “bundine 3ds xl”, which is a trading site on the Internet, received KRW 150,00 from the victim who had contacted the victim E by deceiving him/her, and was remitted KRW 150,00 to the said bank account from the victim.

B. On October 14, 2017, the Defendant posted a notice on “F” online NAF, the Defendant: (a) enticed the victim G by deceiving the victim G who contacted, and (b) transferred KRW 450,000 from the victim to the said bank account.

The Defendant, on October 16, 2017, posted on the above “Ilter” on October 16, 2017, deceiving the victim H who reported and contacted the text.
