A defendant shall be punished by imprisonment for five years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

On May 21, 2012, the Defendant is a married couple in a legal marital relationship with B on May 21, 2012, and the victim C (here, 16 years of age) is born between B and Jeonnam, and the Defendant is a sheshesheshel father’s relation.

1. 성폭력범죄의처벌등에관한특례법위반(친족관계에의한강간) 피고인은 2018. 6.경 이하 불상의 날짜 02:00부터 05:00경 사이에 충북 옥천군 D아파트 E호에 있는 피해자 집 안 피해자의 방에서, 피해자가 잠을 자고 있는 틈을 이용하여 피해자의 몸에 올라타 있다가 피해자가 잠에서 깨자 손으로 피해자의 코와 입을 막고 손으로 주먹질을 하는 시늉을 하면서, ‘너 진짜 죽여 버린다. 이걸로 맞는다’라고 말하여 피해자의 반항을 억압한 다음, 양손을 피해자의 브래지어 안쪽에 집어넣어 피해자의 가슴을 만지면서 입으로는 피해자에게 키스를 하다가 다시 피해자에게 ‘바지를 벗어라’라고 말하였다.

이에 간음을 당할 것을 두려워 한 피해자가 이를 모면하고자 피고인의 성기를 약 10~20초간 핥아주자 피고인은 피해자에게 ‘됐어 그냥 바지 벗어’라고 말하고 강제로 피해자를 바닥에 눕히고, 한손으로 피해자와 코와 입을 막아 반항을 억압하면서 다른 한손으로는 피해자의 바지와 팬티를 벗기고 피해자의 다리를 벌려 간음을 하려고 하였으나, 피해자가 다리에 힘을 주고 반항하여 다리를 벌리지 못하자 자신의 성기를 피해자의 배 등에 약 30~40초간 문질러 피해자의 배와 허벅지 위에 사정을 하였다.

Thus, although the defendant tried to rape the victim's blood, the victim did not resist and did not commit an attempted crime.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;
