A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime

1. On November 3, 2018, the Defendant: (a) sold marijuana in a way that: (b) sent KRW 410,000 to the E account (Account NumberF) in the name-free loan located in Songpa-gu Seoul on the same day, which was known to the said person by using the ATSM machine; and (c) sold marijuana in a way that the said person was concealed into the said mail box in the name-free loan located in Songpa-gu Seoul on the same day; and (d) sold marijuana in a way that the said person was 2g of marijuana, which was concealed by the said person in his name-free loan located in Songpa-gu Seoul on the same day.
2. Around November 3, 2018, the Defendant smoked marijuana in such a way as to put in tobacco the influent quantity among marijuana purchased, as described in paragraph (1), at an influent place in Songpa-gu Seoul.

3. On January 16, 2020, at the Defendant’s relocation residence in Seo-gu Incheon, Seo-gu, and H, the Defendant posted a notice to the effect that “sale of spam trading” is “on the Internet IJ bulletin,” and the Defendant made a false statement to the effect that “if 80,000 won of the price of goods is deposited, spam trading will be sent.”
However, the defendant, who reported and contacted the above article, thought that he sold the above article to another person, and even if he received the price of goods from the victim, he thought that he would use it as living expenses, etc., but did not have the victim's intention or ability to sell the article.
At around 22:09 on the same day from the victim by deceiving the victim as above, the Defendant acquired 80,000 won as the price for the goods from the L Cooperative account (M) in the name of the Defendant and acquired it by deceiving the victim.
